Welcome to Based Coffee (“Based Coffee,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, content, and services (collectively, the “Site”), and any purchase of products through the Site. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use the Site.
Eligibility. You must be at least 13 years old to use the Site and at least 18 to make a purchase. By using the Site, you represent that you meet these requirements. Accounts. If the Site offers accounts, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use. Accuracy. You agree to provide current, complete, and accurate information for all purchases and, if applicable, account registration.
Availability. We strive for accuracy but product availability, descriptions, and pricing may change without notice. We reserve the right to limit, refuse, or cancel any order at our discretion (e.g., suspected fraud). Order Acceptance. Your order is an offer to buy; we accept only when we dispatch the product and send a shipping confirmation. Promotions & Errors. We may correct errors or inaccuracies and change or update information at any time without prior notice.
Based Coffee collects and remits sales tax as required by applicable state and local laws, including destination-based sales tax for Colorado residents. Any applicable taxes will be added at checkout.
Carriers & Timing. We typically ship via USPS/UPS. Processing generally takes 2–3 business days; delivery estimates are 3–7 business days within the U.S., but timing is not guaranteed. Risk of Loss. Title and risk of loss pass to you upon our delivery of the shipment to the carrier. We are not responsible for delays, loss, or theft after transfer to the carrier. Address Issues. You are responsible for providing a correct, deliverable address. If a package is returned for an incorrect/incomplete address, we can reship after receiving the correct address (additional shipping charges may apply).

Coffee & Perishables. All sales of coffee and other perishable items are final and not returnable. If your order arrives damaged, incorrect, or you’re not satisfied, contact us within 14 days and we’ll work with you to send a replacement. Wearables & Merchandise. Since all orders are printed on demand, we are unable to do exchanges or returns. If the product is damaged we will gladly provide a replacement or full refund.

Our IP. The Site and all content (text, graphics, logos, product images, videos, software, and the compilation thereof) are owned by Based Coffee or our licensors and are protected by intellectual property laws. Limited License. We grant you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial use. No Commercial Use. You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any Site content without our prior written consent.
You agree not to, and not to allow others to:
User Content. If the Site allows you to post or submit reviews or other content (“User Content”), you retain ownership of that content, but grant Based Coffee a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, publish, and display such content for operating and improving the Site and our business. Standards. You are solely responsible for User Content. Do not submit unlawful, defamatory, infringing, or misleading content. We may remove any content at our discretion. Feedback. If you submit ideas or suggestions, you grant us the right to use them without restriction or compensation. DMCA. If you believe content on the Site infringes your copyright, contact [email protected] with a takedown request containing all required information under 17 U.S.C. §512.
The Site may contain links to third-party websites or use third-party tools (e.g., payment processors, shipping platforms). We are not responsible for third-party content, policies, or practices. Your use of third-party sites/services is at your own risk and subject to their terms.
By providing your contact information, you agree we may send you transactional and, where permitted, marketing communications. You can opt out of marketing emails at any time via the unsubscribe link.
If we offer subscription products, the terms of the subscription (billing frequency, price, cancellation policy) will be disclosed at checkout. Auto-renewals will continue until you cancel per the instructions provided. You authorize recurring charges until cancellation.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, ITS CONTENT, AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL BASED COFFEE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL; OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID TO BASED COFFEE FOR THE PRODUCT(S) AT ISSUE IN THE 12 MONTHS PRECEDING THE CLAIM OR $100, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations; in such jurisdictions, our liability will be limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Based Coffee and our officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, publicity, confidentiality, property, or privacy right; or (d) any claim that your User Content caused damage to a third party.
